Kondex Corporation (together with its affiliates, subsidiaries, divisions, and brands, collectively, the “Company,” “us,” “we,” or “our,” as the context may require) operates and provides kondex.com, kondexparts.com, our recruiting website, and other websites that link to this Privacy Policy (collectively, the “Website”). 

This Privacy Policy (this “Policy”) describes our privacy practices for the Website, including the types of information we may collect from you when you visit or use the Website and our practices for collecting, using, maintaining, protecting, and disclosing that information. We respect the privacy of the users of the Website (“you” or “your,” as the context may require) and we are committed to protecting your privacy and the security of your personal information through compliance with this Policy.

By accessing or using the Website, you agree to this Policy, our Website Terms of Use, and any other applicable terms.  If you do not agree with our policies and practices, please do not visit, access, use, or otherwise interact with the Website.

This Policy may change from time to time. Your continued use of the Website after we make changes is deemed to be acceptance of those changes, so please check this Policy periodically for updates.

Except as otherwise provided in this Policy, “personal information” is information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with you. “Personal information” does not include information which is generally not considered “personal information” under applicable law or is otherwise exempted under applicable law, such as information which is publicly available or subject to special data privacy laws and/or regulations, or information not otherwise considered “personal information” under applicable law.

We collect several types of information from and about you as a result of your use of the Website and as a result of your communication with us. This information may include:

  • Information that is about you but individually does not identify you, such as information which has been de-identified or aggregated in a manner where it can no longer be used to identify you. For example, Google Analytics collects visitation information and may associate it with your location, search history, and other data collected from websites that partner with Google to provide aggregated and anonymized insights about you.
  • Any other information, including personal information, which you disclose or share.

4. How We Collect Personal Information

We may collect personal information directly from you when you provide it to us, automatically when you use or access the Website, and from our service providers or other third parties, to the extent permitted by applicable law.

Information We Collect Directly

The personal information we collect directly from you when you use or access the Website includes information that you provide by filling in forms, creating an account, searching for products on the Website or making a purchase, submitting or posting content on the Website (including product reviews and other user-generated content), responding to a survey, participating in contests, sweepstakes, or promotions, signing up for marketing communications, requesting customer support, or otherwise communicating with us.

Information We Collect Automatically

As you navigate through and interact with the Website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Usage details. When you access and use the Website, we may automatically collect certain details of your access to and use of the Website, including traffic data, approximate location data, logs, and other communication data and the resources that you access and use on the Website. See Section 7 (Your Privacy Choices) for information on how you can opt out of behavioral tracking and how we respond to web browser signals and other mechanisms that enable you to exercise choice about behavioral tracking.

The information we collect automatically may include personal information. This information helps us to improve the Website and to deliver a better and more personalized service, including by enabling us to estimate our audience size and usage patterns and recognize you when you return to the Website.

The technologies we use for automatic information collection on the Website include cookies. A cookie is a small file that is placed on your computer or mobile device when you visit a website. When you visit the Website again, the cookie allows that site to recognize your browser. Pages of our Website and our emails may also contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

We also utilize third-party analytics providers to help us market, troubleshoot, and provide information about our products and services. We use analytics tools provided by third parties including, but not limited to, Google Analytics, which uses cookies and similar technologies to collect and analyze information about use of the Website and report on activities and trends. Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications, including some advertisements, on the Website are served by third parties, including advertisers, ad networks and servers, content providers, and social media or other application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use the Website. We do not control these third parties’ tracking technologies or how they may be used. We use the information that we collect about you or that you provide to us, including any personal information, to:

  • Communicate with you, process your requests, and complete transactions, such as delivering the products and services that you request or purchase.

  • Notify you about changes to our Website or any products or services we offer or provide though it.
  • Market our products and services to you, including to provide targeted advertising based on your activity on the Website and on third-party websites or other online services.
  • Monitor and analyze trends, usage, and activities in connection with our products and services, including for testing, research, analysis, and product development, and to understand our audience, develop and improve the Website, as well as our customer service, products, and services.
  • Facilitate contests, sweepstakes, promotions, and process and deliver entries.
  • Detect, investigate, and help prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity and help maintain the safety, security, and integrity of the Website, as well as our products, services, databases, and other technology assets.

  • Enforce our rights arising from any contracts entered into between you and us, and for billing and collection.
  • Protect the rights, property, or safety of the Company, our customers, or others, including if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of the Company, our customers, the public, or others.
  • Fulfill the purpose for which you provide it, for any other purpose disclosed by us when you provide the information, or otherwise with your consent.

We also disclose aggregated, anonymized, or de-identified information that cannot reasonably be used to identify you. We process, maintain, and use this information only in an aggregated, anonymized, or de-identified fashion and will not attempt to re-identify such information, except as permitted by law.

7. Your Privacy Choices

We strive to provide you with choices regarding the personal information you provide to us. We have gathered the following mechanisms to provide you with control over your information:

  • Accessing, Correcting, and Updating Your Information. To access and update certain information, you may be able to login and edit your profile, or you can contact us as provided in Section 17 (How to Contact Us). Note that we may not accommodate a request to change information if we believe that the change would violate any law or legal requirement or cause the information to be incorrect. 
  • Tracking Technologies; Device Permissions. You can set your browser to refuse all or some cookies through the notification banner when it is presented to you, through the Cookie Consent Manager, or by setting your browser to refuse some or all cookies. If you disable or refuse cookies, some parts of the Website may then be inaccessible or not function properly. Mobile devices offer permission systems for specific types of device data and notifications, such as phone contacts, pictures, location, and push notifications. You can change your settings on your device to either consent to or refuse the collection or processing of the corresponding information or the display of the corresponding notifications. If you disable or refuse certain permissions, the Website may then be inaccessible or not function properly. Note that the Website does not respond to “do not track” (DNT) signals.
  • Promotional Offers from Us. If you do not wish to have your contact information used by us for promotions, you can opt-out by unsubscribing from any emails you receive from us. Additionally, you can also always opt-out by contacting us as provided in Section 17 (How to Contact Us). This opt-out does not apply to information provided to the Company because of an application submission, registration, or other transactions.
  • Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver targeted advertisements, you can opt out by disabling or refusing the related advertising cookies through the Cookie Consent Manager or by contacting us as provided in Section 17 (How to Contact Us).

We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI's website, https://thenai.org/opt-out. Similarly, you can opt out of receiving targeted ads from members of the Digital Advertising Alliance (“DAA”) on the DAA's website, https://www.privacyrights.info.

If you are a resident of certain jurisdictions (e.g., European Economic Area, California), you may have additional rights and choices regarding your personal information. Please see below for additional information.

8. Security

We implement various physical, administrative, and technical safeguards to protect the security of your personal information both online and offline. The safety and security of your information also depends on you. Where you have a password for access to certain parts of the Website, you are responsible for keeping this password confidential. We ask you do not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to the Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

9. Retention of Personal Information

We retain your personal information only for as long as is necessary to fulfill the purposes for which it was collected and processed, in accordance with our retention policies, and in accordance with applicable laws or until you withdraw your consent (where applicable).

To determine the appropriate retention period for your personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we use your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

10. International Data Transfers

The Website is operated and managed on servers located and operated in the United States, and any information collected through the Website as described in this Policy may be stored in the United States.  As described in this Policy, we may also disclose personal information to our service providers and other third parties, who may be located in the United States or other countries other than your jurisdiction. If you are accessing the Website from outside the United States, please be advised that the United States and other countries may not offer the same privacy protections as the law of your jurisdiction. In certain circumstances, courts, law enforcement agencies, regulatory agencies, or security authorities in those other countries may be entitled to access your personal information. By using the Website, you consent to the transfer of your personal information to, and the storage and further processing of your personal information in, the United States and other countries. 
If you are an individual resident in the province of Quebec, please note that your personal information will be transferred and processed outside of Quebec.

11. Children's Privacy

The Website is not directed to nor intended for use by anyone under 18 years of age (a “Child” or “Children”). We do not knowingly collect personal information from Children. If you are a Child, please do not use the Website or provide any information on the Website. If we learn we have collected or received personal information from a Child, we will delete that information. If you believe we might have any information from or about a Child, please contact us as provided in Section 17 (How to Contact Us).

12. Notice for California Residents

Scope; Definitions

This Section 12 (Notice for California Residents) applies exclusively to visitors and users of the Website who reside in the state of California. We provide our Notice for California Residents to supplement our main Privacy Policy and to comply with California privacy laws, including the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (“CCPA”). Notwithstanding anything to the contrary elsewhere in this Policy, terms defined in the CCPA have the meaning assigned to them under the CCPA when used in this Notice for California Residents. 

If you are a California resident, the CCPA provides you with certain rights regarding your personal information. This Section 12 (Notice for California Residents) includes additional notices with respect to and describes those rights and provides you with additional information regarding our practices regarding the collection, use, disclosure, and sale of personal information. Our Policy explains how we collect, use, and disclose information about you, as well as our targeted advertising and analytics practices. Personal Information That We "Share" or "Sell"

We disclose the following categories of personal information to third parties to engage in targeted advertising and other marketing activities, including to expand the reach and effectiveness of our own marketing campaigns and for third parties' own marketing purposes. These disclosures may be considered “sales” or “sharing” under the CCPA, and the table below provides more information about our practices.

Other Details About Our Information Practices

We collect personal information directly from you (for example, when you place an order on the Website), automatically when you access or use the Website, and from third-party sources, each described in more detail in Section 4 (How We Collect Personal Information).

We do not collect personal information from individuals we know are under the age of 18, so we do not engage in sales or sharing using personal information about individuals we know to be under the age of 18. 

We do not collect sensitive personal information, so we do not use or disclose sensitive personal information for the purpose of inferring characteristics about you.

Our retention periods for personal information are based on business needs and legal requirements. We retain personal information for as long as is necessary for the processing purpose(s) for which we originally collected it and for other business purposes explained in this Policy. For example, we may retain certain transaction details and correspondence until the time limit for claims arising from the transaction has expired. In addition, we retain your email address and information about your marketing preferences to ensure that we can honor those preferences.

Your Privacy Rights

Opt Out of Sales and Sharing

Some of the activities described above may be considered “sales” or “sharing” of your personal information. To opt out of the sale or sharing of your personal information, please submit a request by completing our Do Not Sell or Share My Personal Information form or by calling our toll-free number at 1-800-447-1860. To opt out of sharing via cookies and other trackers, please visit the Cookie Consent Manager and select “Do not sell or share my personal information.”

You can also opt out by visiting the Website with a legally recognized opt-out signal enabled (such as the Global Privacy Control). If you are not logged into your account with us, our processing of the signal will be limited to cookie-based sales or sharing for the specific browser or device that you are using.

Access, Correction, and Deletion

You have the right to (1) request to know more about our collection and use of your personal information and access your personal information, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected about you; (2) request deletion of your personal information, subject to certain exemptions, and (3) request correction of inaccurate personal information. 

To exercise any of these rights, please submit your request by submitting a request through our Privacy Rights Request Form or calling our toll-free number at 1-800-447-1860. We will verify your request by asking you to provide certain information, such as your name, email address, and state of residence. 

You may also access, modify, and delete certain information stored within your online account by logging into your account at any time. 

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within this timeframe, please contact us as provided above.

We try to substantively respond to a verifiable request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period. We cannot respond to your request or provide you with personal information unless we can verify your identity or authority to make the request and confirm the personal information relates to you. If we cannot verify your request within forty-five (45) days of its receipt, we may deny your request.

Any disclosures we provide will only cover the twelve (12) month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Appeals

If we deny your request, you may appeal our decision by contacting us at info@kondex.com. If you have concerns about the results of an appeal, you may contact the attorney general in the state where you reside.

Nondiscrimination

You have the right to not be discriminated against for exercising any of your privacy rights.

Authorized Agents

Where required by law, you can designate an authorized agent to make an opt-out request on your behalf. 
You can also designate an authorized agent to submit an access, deletion, or correction request on your behalf. We may ask authorized agents to submit proof of their authority to make a request, such as a valid power of attorney or proof that they have signed permission from the consumer who is the subject of the request. In some cases, we may contact the individual who is the subject of the request to verify their own identity or confirm the authorized agent has permission to submit the request. If you are an authorized agent seeking to make an access, correction, or deletion request on behalf of a California resident, please submit the request by submitting a request through our Privacy Rights Request Form or calling our toll-free number at 1-800-447-1860.

Shine the Light

California’s Shine the Light law permits California residents to request certain details about how their information is disclosed to third parties for direct marketing purposes. We do not currently disclose personal information to third parties for their direct marketing purposes.

13. Notice for Nevada Residents

This Section 13 applies exclusively to visitors and users of the Website who reside in the state of Nevada. We recognize that we are responsible for personal information under our control. We will thoroughly investigate any complaints received and try to substantively respond within thirty (30) business days of its receipt. If we need more time, we will inform you of the reason and extension period.
